2 1973, the Petitioner seeks quashing of FIR bearing Crime No. 0194/2022, registered at Police Station, Rajendra Nagar, District – Raipur for the offences punishable under Section 363 of the Indian Penal code.
2. On the last date of hearing, the Superintendent of Police, Raipur was
directed to file his personal affidavit for apprizing this Court as to why the investigation in the FIR in question, has not been completed till date. 3. The Superintendent of Police, Raipur, in compliance of the order dated17/06/2025 has filed his personal affidavit. Relevant paragraph of the said affidavit from paragraph 3 onward is reproduced hereunder:-
“2. That the petitioner has preferred the petition bearing CRMP no. 1266/2022 praying for quashing of FIR No. 194/2022 registered at Police Station Rajendra Nagar, Raipur (C.G.) That, the case was listed before the Hon'ble Court on 17.06.2025 and after hearing the Hon'ble Court has directed the counsel for the respective parties, the Hon'ble Court was pleased to direct the deponent to file his personal affidavit in the matter as to why the investigation has not been completed till date. 3. That, the deponent respectfully submits, that, on the basis of the complaint made by the respondent no. 4 namely Yuvraj Singh Parihar an FIR was registered against the petitioner arising out of Crime No. 194/2022 under Section 363 of the Indian Penal Code in P.S. New Rajendra Nagar on 06.07.2022. That, the police conducted a thorough investigation in the matter and a closure report was prepared and the same has been submitted before the concerned court for its approval. A copy of the covering
3 page of the closure report along with the forwarding is annexed as ANNEXURE D/1. 4. That, the deponent tenders his unconditional apology that this fact could not be brought to the notice of the Court at the time of hearing of the matter and he assures/that the same will not be repeated in the future. 5. That, at the cost of repetition, it is further most respectfully submitted that, the deponent has the highest regard toward the orders passed by the Hon'ble Court and is duty bound to comply with the same.”

On perusal of the said affidavit and the closure report annexed as Annexure-D-1 along with the affidavit, it is apparent that the investigation has been concluded pursuant to the FIR dated 06/07/2022 and the closure report dated 04/10/2024 has been forwarded by the CSP, Purana Basti, Raipur to the JMFC, Raipur on 22/10/2024. 5. In view of the above, this CRMP is disposed of.
