ORDER 6.1.2026
Order No.
02.
1. Heard Mr. G.N. Rout, learned counsel for the petitioner and Mr. N.K. Rath, learned counsel for opposite party no.1.
2. Present CMP is directed against order dated 7th August, 2025 of learned Additional District Judge, Nimapara passed in Civil Revision no.14 of 2024 wherein the prayer of present petitioner for hearing on the question of maintainability of the civil revision has been deferred till final hearing of the revision petition.
3. It is submitted on behalf of the petitioner that he is the opposite party in the Civil Revision No.14 of 2024 before the court of Additional District Judge, Nimapara whereas present opposite party no.1 is the petitioner in the civil revision. At the stage of hearing of the civil revision, the opposite party raised the question of maintainability of the civil revision on the ground that the order rejecting the compromise petition is not revisable. But learned revisional court without deciding the question of maintainability proceeded for final hearing of the revision application. Upon hearing both parties and taking note of the circumstances as well as the prayer of the opposite party regarding maintainability of the civil revision, the learned Additional District Judge is directed to decide the question of maintainability of Civil Revision No.14 of 2024 at the 1st instance before proceeding further for disposal of the revision on merit.
5. It is made clear that this court has not expressed any opinion on the merits of the contentions of the parties. Parties present before this court are directed to co-operate for early disposal of the civil revision.
6. With aforesaid observation and direction the CMP is disposed of.
