This application has been preferred by the petitioner for modification of the order dated 29.08.2019 passed in Cr. Appeal (DB) No.475/2017. The modification which has been sought for is with respect to the condition for grant of bail which also includes that one of the bailers should be a close relative of the appellant and the appellant and his bailors shall not change their address without permission of the learned Trial Court. It has been submitted that the appellant has been granted bail on 29.08.2019 but has not been able to fulfil the condition enumerated in the said order and therefore, a prayer has been made that the condition mentioned be deleted and the appellant be directed to be released on personal bond. Learned A.P.P has opposed the prayer for bail. On consideration of the fact that the appellant has spent more than 16 years in custody and has not been released on account of failure on his part to furnish bail bond as directed in the order dated 29.08.2019, the same is accordingly, modified to the extent that the appellant shall be released on furnishing of personal bond. This application stands disposed of with the modification in the order dated 29.08.2019 passed in Cr. Appeal (DB) No.475/2017. Let a copy of this order be sent to the Court concerned through FAX.
