GP FOR REVENUE (AP) The Court made the following: ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- “.... to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents particularly respondent No.4 in seizing the Tractor and Trailer bearing Nos.AP-04-Y-8123 & AP-04-Y-8125 of Mahendra & Mahindra Limited and temporary registration Number of Tractor & Trailer AP-04-UV-TR-2934 of John Deere India Pvt Ltd, with keeping them in his custody 2 without following the procedure contemplated under the A.P.Mines Mineral Concession Rules, 1966 and the Mines and Mineral (D&R) Act, 1957 and the rules made there under as arbitrary illegal an violative of fundamental rights guaranteed to me under Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondents to release the Tractor and Trailer bearing Nos.AP-04-Y-8123 & AP-04-Y-8125 of Mahendra & Mahindra Limited and temporary registration Number of Tractor & Trailer AP-04-UV-TR-2934 of John Deere India Pvt Ltd, in petitioner favour, in the interest of justice.” 2. Mr. M.Jayaram Reddy, learned counsel for the petitioner passed away. Learned Assistant Government Pleader for Mines and Geology is present. 3. As observed from the proceedings sheet, this Court on 18.09.2017 has passed the following interim order: “W.P.No.31628 of 2017 Rule Nisi. Call for records. Notice returnable in four weeks. W.P.M.P.No.39381 of 2017 There shall be interim direction as prayed for, subject to the petitioner paying Rs.75,000/- (Rupees Seventy Five Thousand only) to the respondents. It is further made clear that the petitioner shall not alter the physical features of the vehicle, shall not alienate the vehicle and the same shall be produced as and when required.” 4. On hearing, learned Assistant Government Pleader appearing for the respondents submits that, in view of the interim order of this Court, 3 dated 18.09.2017, the grievance of the petitioner was redressed. Hence, no further orders are required to be passed in the Writ Petition and it may be closed. 5. Recording the above submission, the Writ Petition is closed. There shall be no order as to costs.
