2 / 3 10.1 Issue a writ of Mandamus or any other appropriate writ, order, or direction directing the respondent- Commissioner, Bilaspur Division, to expeditiously hear and dispose of Second Appeal Case No.88/A-6A/2013- 14, filed by the petitioner on 20.07.2015 under Section 44 (2) of the Chhattisgarh Land Revenue Code, 1959. 10.2 Direct the respondent authority to fix an early and final date of hearing and conclude the proceedings within a time-bound schedule as may be deemed fit by this Hon’ble Court. 10.3 Pass such other and further orders as may be deemed just and proper in the facts and circumstances of the case, in the interest of justice.

Learned counsel for the petitioner would submit that the petitioner has filed a Revenue Case No.21A-6A/2011-12 before the Tehsildar, Bilaspur, seeking correction in the revenue records in respect of the land situated at Mouza Kormi, Khasra No.110/11/2, area 0.75 acre, which he purchased by way of a registered sale deed dated 16/04/1962 and thereafter obtained exclusive rights through family partition recorded on 18/12/2007. The Tehsildar rejected the application by order dated 18/07/2014 and the said order was challenged in First Appeal No.88A-6-A/2014-15 before the SDO, Bilaspur, which was also dismissed on 30/05/2015. Thereafter, a second appeal was also filed before the Commissioner, Bilaspur Division on 20/07/2015, however, despite the completion of service upon the respondents in the year 2016 the said second appeal is still pending and no substantial progress has taken place and the
3 / 3 respondents are enjoying the benefit from the incorrect and fraudulent revenue entries. Therefore, it is prayed that the Commissioner, Bilaspur Division may be directed to decide the Second Appeal as early as possible.
3. Learned State counsel submits that they are ready to decide the pending Second Appeal of the petitioner.
4. I have heard learned counsel for the parties and perused the documents on record.
5. Considering the limited prayer made by learned counsel for the petitioner, it is directed that the Commissioner, Bilaspur Division, Bilaspur shall decide the Second Appeal bearing No.88/A-6A/2013- 14 filed under Section 44 (2) of the C.G.LR.C expeditiously as soon as possible.
6. With the aforesaid observation, the instant writ petition stands
