Sl.No. 29 Court No. 35 G.S.Das 25.07.2025 WPA 14060 of 2025 Sunit Singh -Vs- The State of WB & Ors. Mr. Partha Sarathi Das Mr. S. Sarkar Mr. Kausik Biswas Mr. Md. U. E. Sadhique Ms. P. Panda … for the Petitioner(s) Mr. Suman Ghosh Mr. Arka Mondal … for the State-respondent(s) Mr. Sourav Sen Ms. Debdatta Manna … for the respondent no.5 The petitioner is aggrieved by the fact that inspite of informing the police authorities, no steps have been taken. Learned advocate for the private respondents submits that a civil dispute has been given a cloak of a criminal proceeding. The police authorities have no role to play. Learned advocate for the State has submitted a report which reflects that a title suit was preferred being TS 193 of 2025 and the said suit has also been withdrawn. Having considered that there is an existing dispute between the petitioner and the private respondents, both parties are directed to approach the jurisdictional civil court for adjudicating their dispute. Police authorities would only ensure that no breach of the peace and or tranquility takes place. With the aforesaid observations, WPA 14060 of 2025 is disposed of. Pending application(s), if any, is also disposed of. Report so submitted be kept with the record. Copies of the report be handed over to both the parties. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. (Tirthankar Ghosh, J.)
