Neutral Citation No. - 2025:AHC:38039 Court No. - 33 Case :- WRIT - C No. - 7546 of 2025 Petitioner :- Girja Devi @ Virjan Devi Respondent :- State Of U.P. And 13 Others Counsel for Petitioner :- Girja Shanker Mishra,Pratiksha Rai Counsel for Respondent :- Azad Rai,C.S.C. Hon'ble Prakash Padia,J.
1. The petitioner has preferred the present writ petition with the prayer:
"Issue a writ, order or direction in the nature of mandamus directing the Respondent No.2/Sub Divisional Magistrate, Handia, District Prayagraj to decide the Case No. T202402030407472, (Gitja Devi Vs. Virjan Devi vs. Satyanand) under Section 144 U.P. Revenue Code, 2006/2016, expeditously as possible as within short stipulated period which is pending in the Court of Sub Divisional Magistrate Tehsil Handia, District Prayagraj. ii) Issue a writ, order or direction in the nature of mandamus directing the private respondents to make status-quo between the parties in the matter, during the pendency of the Case No. T202402030407472, (Gitja Devi Vs. Virjan Devi vs. Satyanand) under Section 144 U.P. Revenue Code, 2006/2016 before the respondent No.2/Sub Divisional Magistrate Tehsil Handia, District Prayagraj."
2. Heard Ms. Pratiksha Rai, learned counsel for the petitioner, learned Standing Counsel for Respondent nos. 1, 2 and 14, Sri Azad Rai, learned counsel for Respondent No.3. 3. In view of the order proposed to be passed herein, no useful purpose would be served by putting the opposite party to notice and keeping this petition pending before this Court. However, in case the opposite party feels aggrieved by the order his/her right to seek modification/variation of the order is being kept reserved. 4. It is argued that though an application was filed by the petitioner before Respondent No.2 for maintaining status quo in the year 2023 itself but till no orders were passed on the same. It is further argued that Respondent No.2 be directed to decide the entire suit expeditiously. 5. With the consent, the present petition is disposed of directing the Respondent No.2 to pass appropriate orders on the application
filed by petitioner for the grant of interim relief in case the same is still pending consideration in six weeks from the date of presentation of certified copy of this order. 6. In so far as entire suit is concerned, Respondent No.2 is directed to decide the same expeditiously but without granting unnecessary adjournment unless there is no legal impediment.
