This application has been filed on behalf of the State of Jharkhand and other officers of the State Government, seeking permission to withdraw the F.I.R and the entire criminal proceedings in connection with Gumla P.S. Case No.421/2016, corresponding to G.R. Case No.1161/2016, registered under Sections 143, 144, 145, 342, 323 & 353 of the Indian Penal Code. The prosecution case was instituted, alleging therein that on 02.12.2016, Jharkhand Bandh was called by several parties, including Communist Party. On 02.12.2016 at about 6:00 p.m., the respondents were agitating near Sisai Road and they also blocked the road. Mr. Sachin Kumar, learned A.A.G.-II submitted that the respondents were carrying out peaceful protest. It was also submitted that no public policy is involved in this case and as such, the State Government has filed this application for withdrawing the aforesaid case. -2-
Mr. L.C.N. Shahdeo, learned counsel on behalf of the respondents has appeared and submitted that he has no objection if the aforesaid F.I.R is quashed.
Considering the fact that the respondents are alleged to be holding peaceful protest and no public policy is involved in the present case, F.I.R. of Gumla P.S. Case No.421/2016, corresponding to G.R. Case No.1161/2016, stands quashed. Accordingly, this application is allowed. Pending I.A., if any also stands disposed of. (Ambuj Nath, J.) BS/-
