(2) This writ petition, allegedly filed in public interest, is for a mandamus directing the official respondents to get the encroachment removed from water body land situate in Khasra No. 1654, Village Manglore, Tehsil Roorkee, District Haridwar. (3) Learned State Counsel submits that Land Management Committee, which manages the public utility land, has not been impleaded as respondent. (4) Learned Counsel for the petitioner, however, submits that there are orders passed by this Court directing the authorities to remove encroachment from water bodies. (5) Be that as it may, since petitioner has made a representation to the Joint Magistrate, Roorkee and also to the District Magistrate, Haridwar, therefore, writ petition is disposed of by directing the Joint Magistrate, Roorkee to look into the allegations made by the petitioner in his representation, regarding encroachment over water body land. (6) This Court hopes and expects that necessary decision in the matter shall be taken by the Joint Magistrate within three months from the date of production of certified copy of this order, after hearing the persons, allegedly in encroachment over the public land.
