Rakesh Kainthla, Judge The petitioners have )led the present petition for quashing of FIR No. 32 of 2022, dated 7.6.2022, registered for the commission of o1ences punishable under Sections 498-A and 323 read with Section 34 of the Indian Penal Code (IPC) at Police Station Ramshehar, District Solan, H.P. and the consequent proceedings arising out of the FIR based on the compromise e1ected between the parties. 1 Whether reporters of Local Papers may be allowed to see the judgment? Yes. 2025:HHC:38115 2. It has been asserted that the parties have entered into a compromise with the intervention of respectable members of society after the registration of the FIR, and the informant does not want to proceed further with the matter. 3. The statement of the informant/victim was recorded on 12.9.2025, in which she stated that she had entered into a compromise voluntarily. The parties are residing separately after the compromise, and the victim does not want to proceed further with the matter. 4. I have heard learned counsel for the parties and have gone through the records carefully. 5. The FIR was registered as a result of matrimonial discord between the parties. The o1ence punishable under Section 323 of IPC is compoundable under Section 320 of Cr.P.C., and the FIR registered for the commission of an o1ence punishable under Section 498-A can be quashed based on the compromise as per the judgments in Gian Singh versus State, 2012 (10) SCC 303, Narender versus State of Punjab, 2014 (16) SCC 466, Vikas Singh vs. State of H.P.(2023)I DMC 335 (HP) and Sanjay Kumar vs. State of H.P2023 (1) Him L.R. 602, which are binding upon this Court. 2025:HHC:38115 6. 2025:HHC:38115 6. Consequently, the present petition is allowed, and the FIR No. 32 of 2022, dated 7.6.2022, registered for the commission of o1ences punishable under Sections 498-A and 323 read with Section 34 of the IPC at Police Station Ramshehar, District Solan, H.P., and consequent proceedings pending/initiated against the petitioners-accused in pursuance thereto, are ordered to be quashed. 7. Petition stands disposed of in the above terms, so also pending miscellaneous applications, if any. 8. Parties are permitted to produce a copy of this judgment, downloaded from the webpage of the High Court of Himachal Pradesh, before the authorities concerned, and the said authorities shall not insist on the production of a certi)ed copy, but if required, may verify passing of the order from the Website of the High Court.
