ORDER:-
1. The present writ petition is filed questioning the action of the respondent Nos.4 & 5 in undertaking enquiry to decide the rights of the parties to the writ petition and to conduct survey in respect of land admeasuring an extent of Ac.13.50 cents in RS No.172/1 and 172,1B of Mankollu Village, Chatrai Mandal, Krishna District, at the request of respondent Nos.6 to 10 and to mutate their names in the revenue records so as to grant pattadar passbooks and title deeds in favour of respondent Nos.6 to 10 despite the suit in OS No.101 of 2004 is pending, on the file of Senior Civil Judge, Nuzivid. 2. The 4th respondent filed counter affidavit stating that the names of the unofficial respondents were mutated in the revenue records in respect of subject lands, during the year 2018. The counter affidavit further averred that at present they did not receive any application from the unofficial respondents and the Tahsildar never instructed the 5th respondent to conduct survey over the lands in dispute. The counter further reads that the unofficial respondents are in possession of the property. HTCDS,J WP_778_2021

It is further averred in the counter affidavit that the entries in webland adangal in respect of subject lands are not in operation for the present as the digital signature of the Tahsildar was revoked and in view of the same no transactions can be taken up for the subject lands. 4. In view of the categorical assertions made by the 4th respondent in the counter affidavit that there is no proposal or instructions given by the 5th respondent to conduct survey over the subject lands. The cause in the present writ petition does not survive. 5. Accordingly the writ petition is closed. No order as to costs. It is needless to mention that, the parties are directed to agitate their rights in pending suit.
