ORDER:
This criminal petition is filed under Section 482 of Criminal Procedure Code (for short “Cr.P.C.”) to quash the proceedings against the petitioner/accused in Crime No.135 of 2019 on the file of SHO PS Biccavole East Godavari District registered for the offences punishable under Section 420, 409 r/w 34 of Indian Penal Code (for short “I.P.C.”). 2. The above crime has been registered on the basis of the complaint lodged by the Assistant Bank Manager, Axis Bank, T.Nagar Branch, Rajamahendravaram, alleging commission of the offence of criminal breach of trust and cheating by the accused in the course of loan transactions with the bank. 3. Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor, produced a copy of the instructions dated 19.01.2025 received from Station House Officer, Biccavolu Police Station, wherein it is stated that on 19.03.2020, the Superintendent of Police, East Godavari District, Kakinada sent proposals to the D.G.P., A.P., vide C.No.152/DCRB- EG/2020 dated 19.03.2020 for transfer of the case to the C.B.I., and thereafter the D.G.P., A.P. in turn, sent proposals to the Principal Secretary, Home Department, Amaravati vide R.C No.2098/C1/2020 dated 12.05.2020, but the orders are still awaiting. However, the learned Additional Public Prosecutor states that he is not aware of the reasons as to why the proposals are still pending for consideration. 3
4. The learned counsel for the petitioner stated that in similar crimes, all the records were sent to the C.B.I., for further investigation. But, however, in the present case, though the proposals were sent, they are still lying with the Law and Order Department. 5. In view of the same, the Superintendent of Police, Kakinada, is directed to initiate immediate action on the proposals sent by him and refer the matter to the C.B.I., as expeditiously as possible, preferably within a period of four (04) weeks from the date of receipt of copy of this order.
Thereafter, the C.B.I., is directed to complete the investigation in the subject crime in accordance with law. 6. With the above direction, this criminal petition is disposed of.
