By the present petition, the petitioner approached this Court to give direction to the respondent no. 2, District Collector (LA) Tamenglong/ Deputy Commissioner, Tamenglong for making payment of the compensation award dated 16.06.2017 of a sum of Rs. 7,41,51,854.80/- (Rupees seven crore forty one lakh fifty one thousand eight hundred fifty four and eighty paise) only to the petitioner and respondent nos. 3 & 4 herein, as per settlement and joint application dated 25.08.2025. It is submitted that the petitioner and private respondents have settled all their disputes and undertake to share. It is also stated that there is no litigation pending before any forum. [3]

No. 2 in Land compensatory award order No. DC (TML) 11/370 (RLY)09 (Tupul - Imphal) dated 21st March, 2017 and its subsequent amended Award
order dated 15th June, 2017 and 16th June, 2017 to the applicants. Sir,
With due respect we the undersigned would like to draw your kind consideration and favourable action that the award amount of Rs. 7,41,51,854.80 of the Second part of the Land compensatory Award order being No. DC (TML) 11/370 (RLY)09 (Tupul - Imphal) dated 21st March, 2017 and its consequence amendment compensatory Award orders dated 15th June, 2017 and 16th June, 2017 is still laying in your esteem office and on its last amendment order the award was granted in favour of Kh. Lovejoy (Khumba Lovejoy) of Pungmon. That we had been in ligation in the Courts regarding the matter of compensatory awards. That, the District Judge, Imphal West who is the competent Authority under Right to Fair Compensation and Transparency In Land Acquisition and Resettlement Act, 2013 passed an order on 1st March, 2018 in Judl. Misc Case No. 31 of 2017 thereby ordered that the petitioner namely Mr. Namrolung Gondalmel of Makhuam / Marangching Village is not the Interested person or affected land owner of the Award dated 21- 03-2017 or subsequent Awards dated 15-06-2017 and 16-06- 2017 and Respondent No. 4 namely Mr. Meithuanlung Gangmei failed to established any prima facie right and title over the acquired lands mentioned in Sl. 2 and 3. Thus, the application for directing the Collector (LA), Tamenglong to make reference to the Authority are dismissed. That, the order dated 1st, March 2018 was challenged by Makhuam Village Chairman Lanranglung Gondamei and Mr. Namrolung Gondaimei at the High Court of Manipur under CRP (CRP -Art 227) No. 10 of 2024 and W.P (C) No. 452 of 2017 now both the cases was dismissed on withdrawal on 20/8/2025. Mr. Meithuanlung Gangmei was also challenged the said order under W.P (C) No. 311 of 2022 and same was dismissed on withdrawal on 23/07/2025. That, there is no litigation pending before any courts in respect of the said compensatory amount pending dispersal from your office and meanwhile, the applicants who are the disputed parties come an amicable settlement among ourselves that the compensatory award amount of Rs. 7,41,51,854.80 in respect of 2nd Part of the award be distributed to us in the following manner:
1. The applicants agreed that an award amount of Rs.
7,41,51,854.80 in respect of Railway Chainage No. 100540 to 102560 m of an affected area of 22.11 Acre mentioned in Sl. No. 2 in Land compensatory award order No. DC (TML) 11/370 (RLY)09 (Tupul -Imphal dated 21st March, 2017 was awarded in the name of Khumba Lovejoy (Kh. Lovejoy) on 16/06/2017 and the said amount is settled to be shared among us. 2. That a sum of Rs. 2,70,00,000/- (Rupees Two Crores Seventy lakhs) only is settled to be share of Khumba Lovejoy (Kh. Lovejoy) and be transferred in the account No. 06751100000521, IFSC No. PSIB0000675 operated in the said name. 3. That a sum of Rs. 4,41,51,854.80/- (Rupees Four Crores forty- one Lakhs fifty-one Thousand eight hundred fifty-four and eighty paise) only is settled to be shared of Makhuam / Marangching village and be transferred in the name of Mr. Langranglung Gondaimei, present Gazetted Chairman of the village at Account no. 40592538002 IFSC No. SBIN0015718 operated in the said name for and on behalf of Makhuam/Marangching village. 4. That a sum of Rs. 30,00,000/- (Rupees Thirty Lakhs) only is settled to be the share of Kharam Pallen village and be transferred in the name of Mr. Jaiche Tangsinkung, AADHAAR NO. 6355 1392 2911, aged about 69 years S/o late Thangsinso Jaiche, who is a party of registered agreement with Lovejoy
Khumba at the account No. 10160100014255 IFSC NO. BARBOIMPHAL operated in the name for and on behalf of Kharam Pallen village. That, we the applicants have also take an undertaking that there is no case pending in respect of the said compensatory award of Rs. 7,41,51,854.80 mentioned in respect of 2nd Part of the award and we further undertake that no case or suit should not file in respect of the said compensatory award amount in future. Thus, we have settled the dispute among us amicably, so, kindly dispersal the said amounts as stated above.

The present writ petition is allowed with direction to the District Collector (LA) Tamenglong/ Deputy Commissioner, Tamenglong to disburse the compensation amount of Rs. 7,41,51,854.80/- (Rupees seven crore forty one lakh fifty one thousand eight hundred fifty four and eighty paise) only to the petitioner and respondent nos. 3 & 4 in terms of the agreement as recorded in Para nos. 2, 3 & 4 of settlement and joint application dated 25.08.2025 with the conditions that the claim of any interested parties arise in future will be satisfied by the petitioner and respondent nos. 3 & 4. With these observations, the present W.P. (C) No. 742 of of 2025 is disposed of. JUDGE
