ORDER: This CrI'minaI Petition has been filed under Sections 480 and 483 of the Bharatiya NagarI-k Suraksha Sanhita, 2023, seeking to enlarge the Petitioners-accused Nos. 1 to 3 on bail in crime No. 162 of 2024 of old Guntur Police Station, Guntur District, registered for the offence punI'Shable under Section 307 read with Section 34 of the Indian Penal Code. 2. Case of the prosecution is t^hat prior to the date of I'nCident, on 13-02-2024 at about 10 p,m., the de facto complainant went to Anjaneya Swamy Temple in ziyauddin Nagar, Old Guntur. At that time, one Kunapareddy Madhu and accused No. 1 were consuming alcohol and Picked uP quarrel with the de facto complainant. Then, the public pacified the quarrel. Later, on 20-05-2024 at about 9.30 p.m., the petitioners along with other accused came and beat the de facto complainant and his uncle with sticks and rods with intention to kill the de facto complainant due to previous grudges. 3. Sri Ratan Mohan Medida, learned counsel for the petitioners, contends that the petitioners are_ innocents of the alleged offence and have been falsely implicated by the police. lt is further submitted that the petitioners are the sole earning members of their family and, therefore, their continued incarceration would cause undue hardship to their dependents. The petitioners undertake to strictly adhere to any conditions that may be imposed by this court. ln light of =- I *`\--
the foregoing, learned counsel prays that the present petition be allowed in the interest of justice,

Per confra, Ms. Akhila Naidu, learned Assistant Public Prosecutor, vehemently opposed the grant of bail tO the Petitioners, Submitting that the investigation is still underway and several material witnesses remain to be examined. It is contended that if the petitioners are released on bail at this stage, there is a strong likelihood that they may abscond, thereby hampering the `ongoing investigation and evading the process of law. ln view of the foregoing, it |ls urged that the petition be dismissed. 5. Heard learned counsel for the petitioners and learned Assistant Public Prosecutor. Perused the record. 6. As seen from the record, the Petitioners-accused Nos. 1 to 3 had allegedly beaten the de facto complainant and his uncle with sticks and caused bleeding injuries. The nature of the injuries suffered by the Victims are simple in nature. Learned tr'lal Court enlarged accused Nos.
4 to 7 on bail. The petitioners were arrested On 30-06-2025 and have been in judicial custody for the past 53 days. After thorough investigation, the investigating offI'Cer filed the Charge Sheet On 23-07-2025. P.R.C. proceedings are awaited. Keeping the petit'loners in judicial Custody for an indefinite Period WOuld not serve any purpose because it takes considerable length\\of_ t`i_me for the trial court to take up the matter for trial. Considering the facts and circumstances of the case and th'e nature and gravity of the allegations levelled against the petitioners-accused Nos. 1 {o 3 and the fact that the charge sheet has already been filed, this Court is inclined to grant bail to the petitioners-accused Nos. 1 to 3 with the following stringent conditions: (i) The petl|tioners-accused Nos. 1 to 3 shall be enlarged on bail subject to their executing each a bond for a sum of R-s.20,000/- (Rupees twenty thousand only) with two sure{i;s for the like sum each to the satisfaction of learned VI Additional Civil Judge (Junior Division), Guntur; (ii) The petitioners-accused Nos. 1 {o 3 shall appear before the Station House Officer concerned on every Saturday in between 10 a.m. and 5 p.m. till cognizance is taken by the learned the Trial Court; (iii) The petitioners-accused Nos. 1 to 3 shall not leave the limits of the district without prior permission from the investigating officer,I (iv) The petitioners-accused Nos. 1 to 3 shall not commit or indulge in commission of any offence in future; (v) The petitioners-accused Nos. 1 to 3 shall cooperate with the investigating officer in further investigation of the case and sha][

1 to 3 shall not, directly or l'ndirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer; and (viI-) The petitioners-accused Nos. 1 to 3 shall surrender their Passports, if any, to the investI'gating OffI-Cer. If they claim that they do not have passport, they shall submI't an affidavit to that effect to the I'nVeStl'gatI'ng Officer. 8.
