Accused no.1 in Crime No.150/2025 registered by Rajanukunte Police Station, Bengaluru District, for the offences punishable under Sections 108, 3(5), 85, 86 of BNS, 2023, is before this Court under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.150/2025 was registered by Rajanukunte Police Station, Bengaluru District, for the aforesaid offences against the petitioner and others based on the first information dated 17.05.2025 received from Manjula Shivakumar who is the mother of deceased Priyanka. During the course of investigation of the case, petitioner was arrested on 03.06.2025 and subsequently remanded to judicial custody. Bail application filed the petitioner before the jurisdictional Sessions Court in Crl. Misc. No.10107/2025 was rejected on 16.06.2025. Learned Senior Counsel appearing for the petitioner having reiterated the grounds urged in the petition, submits that deceased had left her matrimonial home on 12.05.2025 and she has committed suicide in her parents house on 17.05.2025. No such incident had happened between 12.05.2025 and 17.05.2025 in which the accused have participated which would have either abetted or instigated the deceased to commit suicide. Petitioner is a qualified person working in a software company. Accordingly, he prays to allow the petition. 5. Per contra, learned HCGP has opposed the petition on the ground that investigation of the case is under progress. 6. Perusal of the material on record would go to show that marriage of the petitioner with the deceased was solemnized on 30.04.2023. It appears that subsequently there was some misunderstanding between the couple and on 12.05.2025, the deceased had left the company of her husband and she had taken shelter in her parents house. Deceased Priyanka had committed suicide in her parents house on 17.05.2025. It is alleged that on 12.05.2025, petitioner and his relatives had - 4 - HC-KAR NC: 2025:KHC:23441 CRL.P No. 8579 of 2025 abused and assaulted the deceased and her relatives in her matrimonial home. In respect of the alleged incident that had taken place on 12.05.2025, belatedly FIR in Crime No.104/2025 has been registered by Byappanahalli Police Station, Bengaluru City, based on the first information received on 20.05.2025. There is no material available on record to show that after deceased had left her matrimonial home on 12.05.2025, any such incident had taken place in which the accused persons had participated which could have abetted or instigated the deceased to commit suicide. Deceased had committed suicide in her parents house on 17.05.2025. 7. Petitioner is in custody from 03.06.2025. He is said to be a qualified person working in a software company. The other accused persons are said to have been granted anticipatory bail. Under the circumstances, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 8. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.150/2025 registered by Rajanukunte Police Station, Bengaluru District, for the offences - 5 - HC-KAR NC: 2025:KHC:23441 CRL.P No. 8579 of 2025 punishable under Sections 108, 3(5), 85, 86 of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
