ORDER: No representation for petitioner and respondent No.1.
2. This revision was filed against the dismissal of petition filed under Section 91 Cr.P.C. to send for documents from the learned II Additional Chief Metropolitan Magistrate, Visakhapatnam.
3. As seen from the eCourts, C.C.No.1070 of 2009 was dismissed on
23.07.2019. The order of the learned trial Court is extracted as under: Complainant called absent. No representation, called again at 5.00 p.m., but no representation, since 29.08.2018 there has been no representation for the complainant. On 22.01.2019, the Court ordered the complainant to proceed into the matter as no speaking orders of extension of stay was filed as per the Hon’ble Apex Court Judgment. The Court directed both the parties to attend, but they did not respond and no speaking order extending the stay was filed. The Court adjourning the matter for the attendance of the complainant, by passing conditional orders, but there is no response, they failed to attend the Court inspite of conditional orders and after providing sufficient time by adjourning the matter, it shows that the complainant has no interest in the case, hence the complaint is dismissed for default for the non attendance of the complainant under Section 256(1) of Cr.P.C. and the accused is acquitted under Section 256(1) of Cr.P.C., the bail bonds if any shall stand cancelled after appeal time is over.
4. In view of the above order, nothing remains in this revision. Hence, the Criminal Revision Case is dismissed as infructuous. No order as to costs.
