The petitioners have been made accused in connection with Bolba P.S. Case No.07 of 2024 (S.T. No.72 of 2024) for the offences registered under Sections 323/341/392/34 of the I.P.C. and Section 27 of the Arms Act, pending in the Court of learned Sessions Judge, Simdega. On 30.04.2024, son of the Informant was waylaid by unknown dacoits near Bongo Goifonga forest. Dacoits looted Rs. 35,000/- from him. It appears that petitioner No.2 Subodh Baraik was identified in T.I.Parade as one on the dacoits. Considering the aforesaid facts, I am not inclined to release the petitioner No.2- Subodh Baraik, on bail. Accordingly, his prayer for bail stands rejected. As far as petitioner No.1 Hemant Baraik @ Hemant Chick Baraik is concerned, it was submitted that the petitioner is neither named in the FIR, nor he was put on T.I. Parade. It was further submitted that nothing incriminating has been recovered from his possession. It was finally submitted that similarly situated co-accused Satip Baraik and Ramjeet Baraik @ Ramjit Baraik have been granted bail by this Court earlier. In view of the aforesaid facts, I am inclined to release the petitioner No.1 Hemant Baraik @ Hemant Chick Baraik, on bail. Accordingly, petitioner No.1 Hemant Baraik @ Hemant Chick Baraik is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Sessions Judge, Simdega, in connection with Bolba P.S.
