Order on Board 01/07/2025
1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.208/2025 registered at Police Station Sirgitti, Bilaspur (C.G.) for the offence punishable under Sections GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.07.07 11:49:10 +0530
2 119(1), 308(5), 296, 324(4) of BNS and Sections 25, 27 of the Arms Act.
2. Case of the prosecution, in brief, is that after conducting an investigation against the accused on 30/04/2025, a case was registered under Crime No.208/2025 for offences punishable under Sections 119(1), 308(5), 296, and 324(4) of the Bharatiya Nyaya Sanhita and Sections 25 and 27 of the Arms Act, alleging attempt to assault. After collecting evidence, the investigation was continued against him, and he was arrested and produced before the Trial Court in Bilaspur. A bail application was filed on behalf of the applicant/accused before the Court of the IX Additional Sessions Judge, Bilaspur (CG), which was dismissed on 13/06/2025. Hence this bail application.
3.
Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in this case. He would submit that the applicant is in jail since 30/04/2025 and the conclusion of the trial is likely to take quite long time. Therefore, he prays for releasing the applicant on regular bail.
4. Learned counsel for the State/non-applicant would oppose the bail application. He would submit that the applicant has eight previous criminal antecedents, out of which, three cases are disposed of and five cases are pending against the applicant, therefore he is not entitled for grant of bail.
5. I have heard learned counsel for the parties and perused the case
3 diary.
6. Considering the facts and circumstances of the case, considering the nature of allegation levelled against the applicant and also considering the fact that the applicant has eight previous criminal antecedents, out of which, three cases are disposed of and five cases are pending against the applicant, as such, he is a habitual offender, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail.
7. Accordingly, the bail application of applicant Surajbhan Singh Rajput @ Baraiya involved in Crime No.208/2025 registered at Police Station Sirgitti, Bilaspur (C.G.) for the offence punishable under Sections 119(1), 308(5), 296, 324(4) of BNS and Sections 25, 27 of the Arms Act, is rejected.
8. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information.
