P No.265 of 2025 dated 17.04.2025 Counsel for the Petitioner: AYESHA AZMA S Counsel for the Respondent PUBLIC PROSECUTOR The Court made the following order: 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 8627 OF 2025 ORDER: The instant criminal petition under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C)/under Section 528 of BNSS, has been filed by the Petitioner/Accused, seeking quashment of the order dated 07.07.2025 passed by the learned Additional and Sessions Judge, Anantapuram in Crl.M.P.No.296 of 2025. 2. Heard Smt.Ayesha Azma, learned counsel for the petitioner and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor representing on behalf of the State. 3. Learned counsel for the petitioner submitted that the petitioner could not appear before the trial Court and produce the sureties as directed by the learned I Additional District and Sessions Judge, Anantapuramu, while granting anticipatory bail in Crl.M.P.No.296 of 2025, by order dated 07.07.2025. It is further submitted that on account of the death of the petitioner’s mother-in-law and subsequently, the death of the mother of the learned counsel on record, the petitioner could not comply with the said direction. Learned counsel for the petitioner would further submit that thereafter the petition filed by the petitioner seeking extension of time 4 before the I Additional District and Sessions Judge, Anatapuramu, was dismissed, and against the same the present criminal petition is preferred. 4. Learned Assistant Public Prosecutor opposed the petition. 5. Considering the submissions and a fair look at the impugned order passed by the learned Judge, the death of the petitioner’s mother-in-law occurred on 24.04.2025. The petitioner cannot take it as an advantage seeking extension of time. In that view of the matter, the order passed by the learned Judge is on correct lines. This court does not find any merit in the petition. 6. Accordingly, the criminal petition is disposed of. However, the petitioner is at liberty to surrender before the I Additional District and Sessions Judge, Anatapuramu and move an application for regular bail. On such application, the learned Judge shall consider the same and pass appropriate decision according to the law, as expeditiously as possible.
