ORDER:- The present writ petition is filed questioning the action of the respondents in not paying D.A. and H.R.A. to the Petitioners contrary to their original appointment orders.
2. The facts leading to the filing of the writ petition are as follows: The Petitioners contend that they have been appointed as paramedical staff in terms of G.O.Rt.No.459 dated 22.05.2002 and as per the orders of appointment dated 15.09.2016, it was stated that the Petitioners would be entitled for remuneration of Basic Pay + D.A. + H.R.A. However, subsequently the Government issued G.O.Ms.No.27, Health, Medical and Family Welfare (G1) Department, dated 16.03.2018 modifying the remuneration of the Petitioners to consolidated pay without further increase in D.A. and H.R.A. Thereafter, the Government modified G.O.Ms.No.27 dated 16.03.2018 and issued G.O.Ms.No.167, Health, Medical and Family Welfare (G.1) Department, dated 14.09.2023 stating that the Government had decided to implement 100% gross salary (pay + DA + HRA) fixed annually to the eligible contract employees who are appointed in terms of G.O.Rt.No.217, HM & FW(J.2) Department, dated 26.02.2001 and G.O.Rt.No.802, HM & FW(B.2) Department, dated 25.07.2001 and G.O.Rt.No.459, HM & FW(J.2) Department, dated 22.05.2002.
Learned counsel for the Petitioners would submit that the Petitioners ^ having been appointed in terms of G.O.Rt.No.459 dated 22.05.2002 are entitled for the benefit of G.O.Ms.No.167 dated 14.09.2023. However, the same is not being extended to the Petitioners.
3. Learned Assistant Government Pleader for Services-I seeks time to file
4. counter affidavit. Having considered the submissions of the learned counsel for the Petitioners, the Writ Petition is disposed of with a direction to the Respondents to consider the representation of the Petitioners dated 16.07.2025 for extending the benefit as specified in G.O.Ms.No.167 dated 14.09.2023 as expeditiously as possible. There shall be no order as to costs.
5. As a sequel, miscellaneous applications pending, if any, shall stand closed.
