Accused Nos.1, 2 and 4 to 6 in Crime No.8/2025 registered by Byappanahalli Police Station, Bengaluru, for the offences punishable under Sections 190, 2(36), 2(9), 316(1), 316(2), 318(4) and 61(2) of BNS, 2023, are before this Court under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Learned counsel for the petitioner submits that the dispute between the parties is purely civil in nature and by giving a criminal texture to the civil dispute, criminal case has been registered against the petitioners, who do not have any criminal antecedents. - 3 - HC-KAR NC: 2025:KHC:25308 CRL.P No. 8480 of 2025 3. Learned HCGP at this juncture submits that further proceedings in Crime No.8/2025 registered by Byappanahalli Police Station, Benglauru, which arises from PCR No.73466/2024, pending before the Court of X Addl. CJM, Bengaluru, has been stayed by the Co-ordinate Bench of this Court in Crl.P.No.7305/2025 by order dated 05.06.2025 and in view of the interim order, police do not intend to arrest the accused. This petition has been filed after the interim order was passed in Crl.P.No.7305/2025 and as on the said date, petitioners had no apprehension that they were likely to be arrested in view of the interim order passed in Crl.P.No.7305/2025. 4. The submissions made on both sides is placed on record. Since further proceedings in Crime No.8/2025 registered by Byappanahalli Police Station, Benglauru, has been stayed by the Co-ordinate Bench of this Court in Crl.P.No.7305/2025, as rightly contended by learned HCGP, the apprehension of arrest by accused is misconceived. Learned HCGP has made a submission that the police do not intend to arrest the accused during the pendency of Crl.P.No.7305/2025 in which interim - 4 - HC-KAR NC: 2025:KHC:25308 CRL.P No. 8480 of 2025 order is operating. Under the circumstances, this petition is disposed of with liberty to the petitioners to file a fresh bail application before this Court depending upon the outcome of Crl.P.No.7305/2025.
