3.
Learned Counsel for the petitioner would submit that the petitioner worked as Contract Labourer under Sub-Contractor VANSON of RTPP i.e., as a worker of Turban Generator in RTPP. Learned Counsel for the petitioner would further submit that while he was working as such on 15.10.2016, accidentally he fell down from the 3rd-floor and his both legs were broken. The petitioner underwent treatment for one year. He incurred debts to the tune of Rs.1,50,000/- (Rupees One Lakh Fifty Thousand Only) for his treatment. With great difficulty he could recover and able to stand and walk. Learned Counsel would further submit that his old age parents and physically challenged sister are dependent on the petitioner. Learned Counsel would further submit that the petitioner has made a representation to the respondent No.3 on
15.02.2018. In turn, the respondent No. 3 addressed a letter to the respondent
3
No.2 on 28.05.2018 recommending for providing an employment to the petitioner on humanitarian grounds. But there is no response from the respondent No.2. The petitioner has submitted another application to the respondent No.1 on 14.11.2018 seeking suitable employment as he lost his health while working for the project. Learned Counsel would further submit that a direction may be given to the respondents to consider the representations of the petitioner and pass appropriate orders. 4. Learned Standing Counsel would submit that the Court may pass appropriate orders giving directions to the respondent Nos. 1 and 2 to take a decision over the representations which have been submitted by the petitioner. 5. Considering the submissions made and a fair look at the material placed on record, there is no dispute about the fact that the petitioner worked as a Contract Labourer under Sub-Contractor VANSON of RTPP i.e., as a worker of Turban Generator in RTPP and his legs were broken while discharging his duties. The petitioner is not claiming it as a matter of right but he has submitted representation seeking an alternative employment which suitable to his health conditions on humanitarian terms in the backdrop of his poor family members who are dependent on his income. In that view, it is apposite to dispose of the present petition directing the respondent Nos. 1 and 2 to consider the representation and take appropriate decision according to Governing Rules and law within a period of two (2) months from the date of receipt of copy of this Order.
