ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioners for granting of pre-arrest bail in connection with Crime No.136 of 2025 of Pedavegi Police Station, Eluru District, registered for the alleged offences punishable under Sections 194 of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’).
2. The Petitioners whose names have been found in the report lodged by the de-facto complainant, whose husband committed suicide as the Petitioners compelled him to repay the loan amount taken by the deceased.
3. Ms. P.Akila Naidu, the learned Assistant Public Prosecutor submits that so far, the police have not chosen to show the Petitioners as accused for having committed offence of abetment to commit suicide. Hence, the apprehension of the Petitioners that they would be arrested by the police is only a misplaced one.
4. Indeed, though the names of the Petitioners were found in the report lodged by the de-facto complainant, who is the wife of the deceased, the Petitioners have not yet been shown as accused and a section for the offence of abetment to commit suicide has not been added in the FIR.

5. The Hon’ble Apex Court in Gurbaksh Singh Sibbia v. State of Punjab1, Sushila Aggarwal v. State (NCT of Delhi)2, laid down that anticipatory bail is not maintainable when there is no bonafide reason or belief that the police would arrest the accused.
6. Considering the facts and circumstances of the case, as of now, there are no merits to grant pre-arrest bail to the Petitioners. Hence, this case is
disposed of giving liberty to the Petitioners to approach this Court as and when they are arrayed as accused and they got a reason to believe that they are going to be arrested by the police in future.
