Heard Ms. P. Saharia, learned counsel for the petitioner. Also heard Mr. P.P. Dutta, learned Standing Counsel, Secondary Education Department and Ms. K. Phukan, learned State Counsel for the respondent no. 4. 2. By filing this writ petition, the petitioner has prayed for a direction to the respondent authorities to provincialize the service of the petitioner as Post Graduate teacher of Economics at Rangachahi T.N. Higher Secondary School under Assam Education (Provincialization of Services of Teachers and Re- organisation of Educational Institution) Act, 2017. 3. The case in brief is that the petitioner was initially appointed as subject teacher in Economics on temporary basis by the Secretary of the Managing Committee of Rangachahi T.N. Higher Secondary School vide order dated
13.10.2002. Accordingly, the petitioner joined his service by submitting his joining letter before the Principal of the said School. 4. The Rangachahi T.N. Higher Secondary School was provincialized and after provincialization, the Principal of the School has forwarded a list of Teachers eligible for provincialization of their services, however the services of the petitioner has not been provincialized due to incorrect depiction of less enrolment of the students in Economics subject. 5. Aggrieved, the petitioner brought to the notice of the Inspector of School, Jorhat whereby the authorities has furnished the enrolment and
Page No.# 3/4 appearance of candidates in the Higher Secondary Final Examination, 2016 where the School of the petitioner and his subject i.e., economics were reflected in Serial No. 4 showing the nos. of candidates as 13. 6. The Director of Secondary Education, Assam vide orders dated 26.08.2021 and 29.11.2021 has provincialised the services of 5 nos.
of teachers working in the school w.e.f. 30.11.2021. However, the case of the petitioner was not considered on the ground of less enrolment of students in the Economics subject in 2016. Thereby his name has been dropped out from the list of provincialization. 7. Mr. P.P. Dutta, learned Standing Counsel, Secondary Education Department submits that the case of the petitioner was recommended by the State Level Scrutiny Committee for provincialization of his service. However, due to discrepancies in the enrolment of students in the Economics subject in the year 2016 and the present enrolment of the students in the said subject, a verification process has undertaken which would be finalised shortly. 8. The fact is by and large not disputed. However, due to discrepancies in the enrolment of students in the Economics subject in the year 2016 and the present enrolment of the said School, the authorities appear to have initiated verification which is yet to be finalised. 9. Having considering the above and as agreed to by the learned counsel for the parties, I am of the considered view that no useful purpose would be served by keeping this matter pending as the respondent authorities have already undertaken the process of the verification which would be finalised shortly. 10. Accordingly, the writ petition is disposed of with a direction to the
Page No.# 4/4 respondent authorities to finalize the verification process and pass appropriate orders. 11. It is provided that after verification in the event, if the petitioner is entitled to be provincialized, the same shall be considered and completed by passing appropriate order. However, if the petitioner is not entitle for provincialization, then also appropriate order shall be passed and communicated to the petitioner. The exercise as directed herein above shall be completed within 3 (three) months from the date of receipt of this order. 12. Writ petition, accordingly, stands disposed of. JUDGE Comparing Assistant
