[2025:RJ-JP:34586-DB] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR D.B. Civil Writ Petition No. 15011/2024 Ganga Lehri S/o Shri Jagga Ram, Aged About 63 Years, Resident Of Plot No. 5, Shankar Nagar, Jhotwara, Jaipur, At Present Retd. Mts In The Office Of Railway Mail Service Jaipur Division, Jaipur ----Petitioner Versus 1. Union Of India, Through The Secretary, To The Govt. Of India, Department Of Posts, Sansad Marg, New Delhi. 2. Chief Post Master General, Rajasthan Circle, Jaipur 3. Senior Superintendent Railway Mail Service, Jaipur Division, Jaipur. ----Respondents For Petitioner(s) : Mr. Kailash Chand Sharma, Adv. For Respondent(s) : Mr. V.P. Mathur, Adv. HON'BLE MR. JUSTICE SANJEEV PRAKASH SHARMA HON'BLE MR. JUSTICE SANJEET PUROHIT Order 29/08/2025 1. The petitioner assails the order dated 14.02.2023 passed by the Central Administrative Tribunal, Jaipur, whereby the O.A. No.627/2014 filed by the petitioner was rejected holding that so far as the claim of the petitioner for being allowed to appear in the subsequent examinations in the year 2011 was hypotheticated. 2. We failed to understand as to how the Central Administrative Tribunal did not consider its own interim order dated 19.11.2014 whereby they had allowed the petitioner to participate in the next examination of Lower Grade Officials i.e. examination for promotion of Lower Grade Officials to the post of Postal Assistants. It is revealed that in the examination which was conducted in the [2025:RJ-JP:34586-DB] (2 of 3) [CW-15011/2024] year 2014, the petitioner has passed the examination. When the sealed cover was opened by the Central Administrative Tribunal vide its order dated 10.07.2015, all these aspects were required to be considered while deciding the final O.A. The original claim of the petitioner with reference to the examination conducted in the year 2011 had faded after the petitioner had taken up the plea with regard to the number of chances to which he was entitled to after having been regularized in service in the year 1993. As per the scheme, the first examination which candidate could give after having been regularized, would be after five years of service, however, it is an admitted position that the petitioner had been participating in the examination before that after completing three years of service. 3. Be that as it may, the claim of the petitioner stands substantiated further as the provision of embargo of eight chances stood washed off by the subsequent circular issued by the Department of Post, Govt. of India dated 13.05.2019. 4. Keeping in view the aforesaid aspects, we are inclined to partly allow the present Civil Writ Petition to the extent of directing the respondents to consider the case of the petitioner for promotion, in terms of the examination relating to year 2014. He would, therefore, be only entitled for being considered for promotion against the vacancies which may arise in the year 2014 onwards as per his seniority. The benefit shall be given to him notionally, till the date of superannuation and his retiral benefits shall also be calculated accordingly and actual arrears of retiral benefits shall be paid. The exercise shall be conducted within a period of two months. [2025:RJ-JP:34586-DB] (3 of 3) [CW-15011/2024] 5. The present Civil Writ Petition is accordingly, partly allowed. 6. Pending application(s), if any, stand disposed of. (SANJEET PUROHIT),J (SANJEEV PRAKASH SHARMA),J HEENA/MAHIMA/08
