1. The applicant who is in custody since 13.08.2023 has renewed the prayer for grant of regular bail in connection with NCB Crime No.12/NCB/RANCHI/2020, corresponding to NDPS Case No.45 of 2020, registered for the offence under Sections 8 (c) r/w 20(b) (ii) (c), 25 and 29 of the NDPS Act, pending in the court of learned Addl. Judicial Commissioner-II-cum- Spl. Judge NDPS, Ranchi.
2. Earlier the bail application of this applicant was rejected on merit vide
order dated 28.02.2024 passed in B.A. No.9298 of 2023. This is the second attempt.
3. A report was called for from the court concerned. From perusal of the report it appear that out of eight charge sheeted witnesses, five witnesses have already been examined. On the above basis, prayer for bail has been renewed.
4.
Learned counsel for the U.O.I. has opposed the prayer for bail of the applicant.
5. Considering the stage of the trial, I am not inclined to enlarge the applicant on bail, at this stage. Accordingly, prayer for bail of the applicant stands rejected once again.
6. However, the applicant is at liberty to renew his prayer for bail, if the trial is not concluded within six months. (Rajesh Kumar, J.)
