Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with G.R Case No.640 of 2025 pending in the file of learned S.D.J.M. (S), Cuttack arising out of Purighat P.S. Case No.257 of 2025 on the grounds stated. 3. Perused the FIR as at Annexure-1. A copy of the Zimanama dated 30th August, 2025 is produced to claim that there has been recovery of cash of Rs.1.5 lac and pure gold of 15 grams. It is claimed by learned counsel for the petitioner that the gold was returned by the present accused and upon seizure of the same, it was handed over to the informant. Apart from the above recovery, as earlier stated, cash was seized and received back by the informant. It is claimed that the said cash p. 2 was recovered from the co-accused and not from the petitioner. Recorded the objection of learned counsel for the State and submission of learned counsel for the informant, according to whom, gold items worth of Rs.10 lac was removed. But the Court is informed that four other persons are involved in the alleged mischief including the petitioner. Recording the submission that 15 grams of gold was recovered from the petitioner and handed over to the I.O. by him, hence, left in zima of the informant and the objection from the side of the informant and also the State and in the meantime, it is also informed that notice under Section 35(3) BNSS was issued to him, this Court pending closure of the investigation is inclined to direct the petitioner to surrender before the learned court below for being released on bail with suitable conditions imposed. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioner surrenders before the court of learned S.D.J.M. (S), Cuttack within a fortnight from today, it is directed that he shall be released on bail in connection with G.R Case No.640 of 2025 corresponding to Purighat P.S. Case No.257 of 2025 with such other conditions imposed by the court concerned as deemed just and proper and in the facts and circumstances of the case besides the following, such as, he shall cooperate the I.O. in the investigation as and when summoned. p. 3 6.
