This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... a Writ of Mandamus declaring the inaction of Respondents 1 to 4, particularly the 4th Respondent, in failing to register a First Information Report (FIR) or take any action on petitioners repeated complaints dated 22.03.2025, 23.07.2025, and 28.07.2025 against Respondents 5 to 32 for committing cognizable offenses, including criminal trespass, criminal intimidation with deadly weapons, and illegal land encroachment, in spite of the law laid down by Honble Supreme Court of India in Lalita Kumari vs Govt.of U.P. and Ors as illegal, irregular, irrational, amounts to non discharge of legal

obligation conferred on them under the provisions of Bharatiya Nagarik Suraksha Sanhita, 2023 and offends Articles 14 and 21 of Constitution of India and consequently direct the respondents 2 to 4 to register the crime on petitioners said complaints and prosecute the accused 5 to 32 for appropriate offences and penal provisions of law.”

Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, based on the complaint given by the Petitioner, a case in Crime No.67 of 2025 for the offences under Sections 329(3), 351(20 read with 3(5) of BNS on the file of Kallur Police Station and the case is under investigation. 3. Sri C.Rajendra, learned counsel for the Petitioner would submit, recording the same, the petition may be disposed of. 4. Considering the submissions made, the Writ Petition is disposed of. There shall be no order as to costs.
