WRIT PETITION No.20335 OF 2019 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
“….to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring action of the respondents 2 to 6 in not taking any action on petitioner complaints in Cr.No. 207 of 2018 on the file of Lalapeta Police Station, complaints dt.31.08.2018, 25.10.2018, 27.11.2018, 31.12.2018, 18.01.2019, 04.02.2019, 15.05.2019 and 27.06.2019 against the unofficial respondents and high-hande5d activity of the police as illegal, irregular, arbitrary and violative of the provisions of Criminal procedure Code and also offends Article 14, 21 and 300 A of Constitution of India and consequently direct the respondents to change the investigation officer in Cr.No.207 of 2018 on the file of Lalapeta Police Station to any other independent investigation agency…”
2. Heard Sri Mangena Sre Rama Rao, learned counsel for the writ petitioners and learned Asst.Govt. Pleader for Home. 3. Learned Assistant Government Pleader for Home on written instructions would submit that police conducted investigation into the case, and filed final report before the jurisdictional Magistrate referring
4 the case as ‘undetectable’ vide C.No.208/Ref/SDPO-East/2019, dated 08.09.2019. 4. In the light of submissions made by Learned Assistant Government Pleader for Home, the petitioner is at liberty to approach the jurisdictional Magistrate for necessary rederessal on the final report as per the judgment of the Hon’ble Apex Court in the case of M.Subramaniam and another Vs. S.Janaki and another1. 5. In that view of the matter, nothing remains for adjudication in the writ petition. 6. Accordingly, the Writ Petition is closed, without going into merits of the case. There shall be no order as to costs. As a sequel thereto, interlocutory applications, if any, pending in this Writ Petition shall stand closed.
