ORDER
The above contempt case is filed complaining non-implementation of
order dated 16.04.2024 in W.P.No.18284 of 2017.
2. The petitioners filed the said writ petition to declare the action of 2nd respondent-corporation in laying road across their plot bearing Nos.23 and 24 on southern side in Sy.No.59-A & 59-2-C in Ward No.6, Anantapur, Anantapur District, violating the orders dated 21.01.2013 in W.P.No.14998 of 2005, as illegal and arbitrary.
3. The said writ petition was disposed of on 16.04.2024 directing the 2nd respondent to restore the property to the petitioners, wherein road was laid. Complaining non-implementation, the above contempt case is filed.
4. Pending the contempt case, the respondents restored the land to the petitioners on 10.03.2025. The 2nd petitioner gave statement and copy of the statement is filed along with the affidavit of the respondent. Along with the affidavit, compliance report was also filed regarding restoration of land to the petitioners. In the affidavit, the respondent offered unconditional apology.
5. Since the land was restored to the petitioners, though with certain delay, given the facts and circumstances of the case, the Contempt Case is Closed. The respondent is discharged from the contempt proceedings. No costs.
As a sequel, pending miscellaneous petitions, if any, shall stand closed.
