Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents in not preparing and paying final bill amounts for the work executed by the petitioner namely i.e. Podili Nagara Panchayat - ASC Grants/General Funds - Engaging of Tankers on hire basis for transportation of water in Town, vide Agt. THE HON’BLE SRI JUSTICE HARINATH.N WRIT PETITION No.21927 OF 2025 ORDER:
1. The petitioner was entrusted with the work of transportation, supply, and delivery of potable water in the town of Podili. The petitioner was required to arrange the necessary number of tractors and tankers for the supply of water. The 4th respondent entrusted the work and the petitioner duly completed it. The supplies were also recorded in the M- Book by the Commissioner of the Podili Nagara Panchayat, who is the 4th respondent herein. It is submitted that although the water was supplied and duly certified in the M-Books, no payments have been made. It is further submitted that the 4th respondent authority is responsible for quantifying the payments to be made. The tender was called for an amount of Rs.37,84,100/-, and the petitioner completed the work as per the agreement within a period of three months. 2. Heard the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration & Urban Development, appearing for respondents, 1, 3 and 5 to 7, the learned Assistant Government Pleader for Finance & Planning, appearing for respondent No.2, and the learned standing counsel appearing for respondents 4 and 8. 3. Considering the submissions, there shall be a direction to the 4th respondent to quantify and verify and release the due payable to the
