Dubey, A.P.P. --- 06 / 25.02.2025 Heard the parties. 2. Petitioner has been made accused in connection with Jainagar P.S. Case No. 147 of 2024 for the offences registered under section 87 of the Bharatiya Nyaya Sanhita, 2023 and sections 4/8/12 of POCSO, pending in the court of learned Sub Divisional Judicial Magistrate, Koderma. 3. On 28.07.2024, petitioner is alleged to have enticed away the daughter of the Informant to leave her lawful guardianship. Statement of the victim was recorded under section 183 of the B.N.S.S. in which she has stated that she has left her lawful guardianship according to her own wish because her brother had chastised her. She has further stated that she had gone to the house of the petitioner and the petitioner asked her to return back. However, she insisted that she will stay with the petitioner. She has not stated that she was subjected to any sexual atrocity. 4. Mr. Sunil Kumar Dubey, learned A.P.P has opposed the prayer for bail. 5. In view of the submission made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Sub Divisional Judicial Magistrate, Koderma in connection with Jainagar P.S.
