Sharma, learned Additional Advocate General, appears and waives service of notice on behalf of the respondents in both these petitions. 2. With the consent of learned counsel for the parties, both the matters are heard at this stage. 1 Whether reporters of the local papers may be allowed to see the judgment? yes 2 3. These writ petitions have been filed for grant of following substantive reliefs:- i) Issue an appropriate writ, order or direction in the nature of Certiorari for quashing the orders dated 26.02.2010, to the extent the regularization of petition w.e.f. 26.02.2010 instead of 01.01.2007. ii) Issue an appropriate writ, order or direction in the nature Mandamus directing respondent-department to regularize the daily waged services of petitioners w.e.f. 01.01.2007 instead of 26.02.2010 in terms of regularization policy framed by the respondent-State, with all consequential benefits. iii) That accordingly, the respondent-department may kindly be directed to re-affix the pay allowances, increments and other service benefits and pay the arrears in favour of the petitioners alongwith interest @12% p.a., within time bound manner. At this stage, learned counsel for the petitioner(s) submitted that these petitions be treated only for conferment of work charge status in terms of law laid down by the Hon’ble Apex Court in The State of Himachal Pradesh & Ors. Versus Surajmani & Anr.2. The respondent-Department was also the appellant before the Hon’ble Supreme Court in some of the connected matters. Learned counsel further submits that the petitioner(s) would be satisfied in case the respondents are directed to examine their case in light of the aforesaid judgment within a fixed time schedule. Learned Additional Advocate General is not averse to this prayer. 2 Civil Appeal No.1595 of 2025, decided alongwith connected civil appeals on 06.02.2025 3 4. Having regard to the afore-submissions, but without examining the merits of the matter, these writ petitions are disposed of with direction to respondents/competent authority to consider and decide the case of the petitioner(s) in accordance with law laid down in Surajmani2 within a period of six weeks from today. The decision so arrived at shall also be communicated to the petitioner(s). These writ petitions stand disposed of in the above terms, so also the pending miscellaneous application(s), if any.
