(Oral) The applicant is in judicial custody in FIR/Case Crime No.704 of 2023, dated 29.08.2023, under Sections 304, 325, 504, 506, 34 IPC and Sections 4/25 of the Arms Act, 1959, Police Station Kotwali Laksar, District Haridwar. He has sought his release on bail. It is second bail application of the applicant. His first bail application has already been dismissed as withdrawn on 04.03.2025. 2. Heard learned counsel for the parties and perused the record. 3. It is argued that two prosecution witnesses have already been declared hostile; they have not supported the prosecution case; the prosecution relying on video recording, but it has never been forwarded for forensic examination; after rejection of the first bail application, two accused have already been granted bail. 4. Learned State Counsel admits these facts. 2 5. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 6. The bail application is allowed. 7. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
