JUSTICE AMBUJ NATH ----- For the Petitioner: M/s. K. S. Nanda, Advocate For the State : M/s. Vishwanath Roy, Spl.P.P --- 06/07.04.2025 Heard the Parties. Petitioner has been made an accused in connection with Jaldega P.S. Case No. 35/2023, registered for the offence under Sections 302, 201 of the I.P.C., pending in the Court of learned S.D.J.M., Simdega. On 02.08.2023, dead body of an unknown person was recovered from Mama-Bhagina Road. Later on, the dead body was identified to be that of Pankaj Yadav. During the course of investigation, it transpired two witnesses had left the deceased at Harmu Road Ranchi. Thereafter, the deceased had gone with two persons on a motorcycle bearing registration number OD-23- L-9488. It further transpired that some of the witnesses have stated that they had seen the petitioner and co-accused Pradeep Sharma assaulting the deceased. Learned lawyer for the petitioner submitted that the statement of witness Vishal Kumar was recorded after one and half year from the date of occurrence. Learned Special P.P. has opposed the prayer for bail and submitted that the motorcycle on which the deceased was taken by unknown persons belonged to the petitioner and this fact has been verified from the DTO office, Ranchi. Regard being had to the facts and circumstance of the case; I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is hereby rejected. (Ambuj Nath, J.) Saurabh uploaded
