The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita, has been filed to quash the order dated 04.03.2025 passed by Judicial Magistrate Khair, Alighar in Criminal Case No. 365 of 2018, (State Vs. Sunil Joshan) arising out of Case Crime No. 333 of 2018, under Sections 406, 420, 506 of I.P.C., Police Station- Khair, District- Aligarh, whereby the cash amount/F.D. is not found appropriate to furnish the sureties in bail order. Learned counsel for the applicant submitted that bail order has been passed by Co-ordinate Bench of this Court without requiring any local surety. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
