ORAL ORDER
1. Accused No.3 in SC No.11/2025 pending before the Court of III Addl. District and Sessions Judge, Ramanagara, arising out of Crime No.334/2024 registered by Tavarekere Police Station, Ramanagara, for the offences punishable under Sections 126(2), 127(2), 115(2), 118(1), 103(1) and 3(5) of BNS, 2023, is before this Court under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.334/2024 was registered by Tavarekere Police Station, Ramanagara, for the offences punishable under Sections 103(1) and 127(2) of BNS, 2023, against Manjunatha and others based on the first information dated 04.11.2024 received from Nagesh, brother of deceased Ambarisha. During the course of investigation of the case, petitioner herein was arrested on 08.11.2024 and subsequently, remanded to judicial

custody. After completing investigation, charge sheet has been filed against three persons and petitioner is arraigned as accused No.3 in the charge sheet. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.294/2025 was rejected on 22.04.2025. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that petitioner's name is not found in the FIR. He was subsequently arrested during the course of investigation on 08.11.2024 and thereafter, remanded to judicial custody. After completing investigation, charge sheet has been filed against three persons. In the charge sheet, it is alleged that wife of accused No.1 allegedly had illicit relationship with the deceased Ambarisha. After coming to know about the same, accused No.1 had warned Ambarisha and inspite of the same, his wife continued the relationship with accused No.1. Therefore, accused No.1 and his friends accused Nos.2 and 3 allegedly had conspired to commit the murder of Ambarisha. On 03.11.2024, they allegedly had followed the deceased in their vehicles and thereafter had taken him to an isolated place and had assaulted him. The allegation of assaulting Ambarisha with a knife is

found as against accused Nos.1 and 2. There is no such allegation as against petitioner, who is arraigned as accused No.3. Even otherwise, the entire case of the prosecution is based on circumstantial evidence. Petitioner, who has no other criminal antecedents is in custody from 08.11.2024.
Trial in the case is yet to commence. Accused Nos.1 and 2 are already arrested and are said to be in custody. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:-
5. The petition is allowed. The petitioner is directed to be enlarged on bail in SC No.11/2025 pending before the Court of III Addl. District and Sessions Judge, Ramanagara, arising out of Crime No.334/2024 registered by Tavarekere Police Station, Ramanagara, for the offences punishable under Sections 126(2), 127(2), 115(2), 118(1), 103(1) and 3(5) of BNS, 2023, subject to the following conditions:
a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;

b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
