ORDER:
The instant criminal petition under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C)/under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) has been filed by the Petitioners/Accused Nos.2 and 3, seeking quashment of the proceedings pending against them in C.C. No. 395 of 2022 on the file of learned I Additional Junior Civil Judge-cum-I Additional Judicial First Class Magistrate, Narasapuram, West Godavari District, for the offences punishable under Sections 417, 420 r/w 34 I.P.C and Sections 3, 4 and 76 of Chit Fund Act.
2. Heard Sri V.Uday Kumar, learned counsel for the Petitioners/Accused Nos.2 and 3 and Ms. K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State.

Learned counsel for the petitioners would further submit that the petition may be disposed of without causing any prejudice to the rights and
contentions of the petitioners by dispensing the presence of the petitioners before the Trial Court.
4. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders.

5. Considering the submissions, the Criminal Petition is disposed of. However, the presence of the petitioners/Accused Nos.2 and 3 before the Trial Court is dispensed with, unless their presence is specifically directed by the Trial Court. However, petitioners/Accused Nos.2 and 3 are at liberty to raise all the contentions before the Trial Court in the defence. The learned Trial Judge may consider them and take appropriate decision over the matter at appropriate time.
