The petitioner claims appointment on the post of Panchayat Sahayak-cum-Data-Entry-Operator at Gram Panchayat Shivpur, Block Khadda, District Kushinagar on the basis of resolution passed by Gram Panchyat in this regard on 10th September, 2022. It is submitted on behalf of the petitioner that in the above regard all formalities have completed and now matter is pending consideration before District Panchayat Raj Officer, Kushinagar who has to take final call in the matter. Learned counsel for the petitioner further submitted that in the event there is no other legal impediment, petitioner deserves to be offered appointment on the post in question. Sri Sudhir Bharti, learned counsel for the respondent Gram Sabha as well as learned Standing Counsel submits that petitioner instead of approaching Assistant Development Officer (Panchayat), should have approached directly the District Panchayat Raj Officer, Kushinagar, who could have been directed to take appropriate decision in the matter. Accordingly, this petition stands disposed of with direction to the petitioner to approach by means of application alongwith certified copy of this order before District Panchayat Raj Officer, Kushinagar, who shall look into and consider the claim of the petitioner and shall pass final decision in the matter within a maximum period of thirty days from the date of presentation of certified copy of this order. It is further provided that since formalities have been completed and reports were submitted in favour of petitioner, if there is not legal impediment, the District Panchayat Raj Officer, Kushinagar shall direct for appointment of the petitioner on the post of Panchayat Sahayak-cum-Data-Entry-Operator at the Gram Panchyat concerned by passing appropriate order within the same period.
