For Petitioner : Mr.A.Saravanan For Respondent : Mr.T.Annamalai for Mr.S.Rajkumar ORDER The husband has filed the present revision challenging the order of interim maintenance in I.A. No.3 of 2023 taken out by the respondent/wife in HMOP. No.517 of 2020. The wife has sought for interim maintenance of Rs.25,000/-. The wife has alleged that the petitioner doing real estate business and also carrying on profession of Tailor. The petitioner/husband has contested the Application and stating that the petitioner has purchased 1/4 https://www.mhc.tn.gov.in/judis
properties in the name of the respondent/wife and the respondent is getting rental income not less than Rs.30,000/-.

However, the Family Court, Thiruppur, on enquiry has found that the petitioner/husband has not been able to substantiate that the respondent is getting a rental income Rs.30,000/- and has not filed any docuements in support of such self serving claims. Considering the over all circumstances and situation of the parties, the Family Court has granted an interim maintenance of Rs.7,000/- as against the claim of Rs.25,000/-.

I find from the records that the respondent/husband has admitted that he has purchased valuable properties and also put up construction expending more than Rs.50,00,000/- to benefit the petitioner/wife. No doubt, there are civil disputes pending with regard to the enjoyment of the properties, the fact reamains that the respondent has been capable of investing huge money to the tune of Rs.50 lakhs and therefore, I do not find the award of Rs.7,000/- being unreasonable requiring interference under Article 227 of the Constitution of India. 2/4 https://www.mhc.tn.gov.in/judis
