The present contempt application has been filed pleading willful disobedience of the order dated 27.11.2024 passed by a Division Bench of this Court in Writ - C No. 39193 of 2024 whereby the Court had directed the concerned respondent to take all consequential steps pursuant to the order dated 23.7024 passed by the District Magistrate under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. The order dated 23.7.2024 has also been annexed with the affidavit. It is the plea of the applicant that the opposite party, i.e., the Deputy Commissioner of Police is not taking any steps as stipulated by this Court in its order dated 27.11.2024. The Contempt Court exercising powers under Section 12 of the Contempt of Courts Act, 1971 or under Article 215 of the Constitution of India is not the executing court of the orders of the District Magistrate. The applicant may exercise other remedies available to it in law. The application is dismissed.
