The petitioner has been made accused in connection with Raneshwar P.S. Case No. 06 of 2024, corresponding to G.R. No.478 of 2024, S.T. No.123 of 2024, for the offence registered under Sections 302/34 of the Indian Penal Code, pending in the court of learned Additional Sessions Judge-III, Dumka. During the intervening period of 17/18.02.2024, petitioner is alleged to have strangulated his wife. Learned counsel for the petitioner has submitted that the dead body of the deceased was recovered from a forest. It was further submitted that there is no eyewitness to the occurrence. Learned A.P.P on behalf of the State has drawn attention of this Court towards paragraph-67 of the case diary and from perusal of which, it appears that at the time of occurrence, the tower locations of mobile phone of the petitioner and the deceased were found at the same place, i.e at the place of occurrence. Considering the nature of allegation, I am not inclined to release the petitioner, on bail. Accordingly, the prayer for bail of the petitioner is hereby rejected. (Ambuj Nath, J.) BS/-
