GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the respondents 3 and 4 in calling the petitioners to the 3 respondent police station on the instigation of the respondents 5 to 8 without following due process of law, without registration of any complaint is illegal, arbitrary, unjust, unreasonable and against the principles of natural justice and further declare the action of the respondents in interfering with the civil dispute pending between the 4 petitioner and respondents 5 to 8 is also illegal, arbitrary and violative of Article 21 of the Constitution of India and consequently direct the respondents 3 and 4 not to interfere with personal liberty and not to harass by calling the petitioners to the 3RD respondent police station i.e. SHO, Kurnool I Town Police Station, Kurnool District without following due process of law.” 2. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that crime is registered against the Petitioners and that the Police are not calling the Petitioners and his family members to the Police Station. 3. Sri Ch.Ravinder, learned counsel for the Petitioners would submit that, recording the same, the petition may be disposed of. 4. Considering the submissions made, the Writ Petition is disposed of directing the Police not to call the Petitioners to the Police Station, in the 3 absence of any crime registered against them. In case any crime is registered against the Petitioners, Police are directed to follow due process of law. There shall be no order as to costs.
