1. Mr. Rajendra Singh Azad, learned counsel for the applicant through V.C.
2. Mr. Siddhartha Bisht, learned A.G.A. for the State.

4. The present applicant ‘Rajja’ S/o Nagendra is praying for regular bail in relation to First Information report dated 06.10.2024 bearing FIR No. 400 of 2024 P.S. Jhabrera, District Haridwar, which was lodged against unknown persons for the offences punishable under Sections 103(1) of BNS, 2023.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and without collecting any credible evidence the applicant has been chargesheeted for the offense punishable under Sections 103(1), 3(5) and 238 of BNS, 2023.

Mr. Rajendra Singh Azad, learned counsel further submits that in paragraph 7 a specific averment has been made by the I.O. in its counter affidavit that there is no recovery from the present applicant and furthermore in paragraph 8 it has also been categorically mentioned that no role of assault has been shown against the accused/applicant and he has no previous criminal history.

Mr. Siddhartha Singh Bisht, learned A.G.A. submits that though no specific role was assigned to the present applicant but he take active participation in the commission of this crime in association with two other co-accused Deepak and Tinku. He submits that there are CCTV footages and also TIP was done.
8. After hearing the arguments of learned counsel for the parties and further after gone through with the counter affidavit, this court is of the view that the applicant does not deserve for
2025:UHC:5547 bail.
9. Accordingly, the bail application is rejected.
