2. This is an application under Section 430 of the BNSS, 2023 praying for suspension of sentence and for releasing the applicant on bail.
3. Mr. Baruah as well as Mr. Tewari have objected to this petition on the ground that there are sufficient evidence against the present petitioner.
4. I have considered the submissions made by the learned counsel of both sides.
5. After hearing the learned counsel of both sides, it is hereby directed that the sentence imposed upon the applicant Raju Hazarika alias Borah by the learned Addl. Sessions Judge, Lakhimpur, North Lakhimpur in Sessions Case No.105(NL)/2024 shall remain stayed till disposal of the connected appeal.
6. The applicant Raju Hazarika alias Borah shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the learned Sessions Judge, Lakhimpur, North Lakhimpur. With the aforesaid direction, the IA stands disposed of.
