Cases, Raipur (CG) in Criminal Appeal No.162/2021, arising out of the order dated 14.09.2021 passed by the learned Judicial Magistrate First Class, Raipur (C.G.) in Criminal Complaint Case No. 1744/2016, whereby the learned trial Court has dismissed the complaint filed by the present appellant and acquitted the respondent/accused of the charge for commission of offence under Section 138 of the Negotiable Instrument Act. 2. Learned counsel for the appellant seeks permission of this Court to withdraw the present appeal with liberty to file an appropriate application before the appropriate Court. Further, he prays that the certified copy of the impugned order may be returned to him. 3. Learned counsel for the respondent has no objection to the proposition put forth by the counsel for the appellant. 4. Prayer is allowed. 5. Accordingly, the instant appeal is dismissed as withdrawn with the aforesaid liberty.
