GP FOR HOME The Court made the following: 2 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus to declare the action of the respondent No.4 in calling the petitioners to police station, threatening them not to file any FIR against the unofficial respondents herein, orally demanding to enter into settlement with the respondent no. 5 and threatening with dire consequences if the petitioners do not obey them and as such posing a threat to the life and personal liberty of the petitioners without following due process of law as arbitrary, illegal and violation of Articles 14, 19 21 of the Constitution of India and consequently direct the respondents not to disturb the personal liberty of the petitioner in the interest of justice.” 2. Ms.Y.Bhanusri Akhila, learned counsel for the Petitioners would submit that, in fact the Petitioners want to lodge a case against the unofficial Respondents and they have been visiting the Police Station for the last one month, but there is no response from the Police and in turn, the Police have been visiting the house of the Petitioners and threatening them not to lodge any case against the unofficial Respondents. Learned counsel would further submit that, the Petitioners have addressed a letter to the Superintendent of Police, but no action has been taken. It is further submitted that a crime has been registered against the Petitioners on 21.07.2025, but after filing the present petition, the Police have issued a notice to the Petitioners under Section 41-A Cr.P.C. 3. Sri V.Farooq, learned Assistant Government Pleader for Home would submit that a case in Crime No.118 of 2025 has been registered against the Petitioners for the offences under Section 118(1) and 351(2) of BNS. 3 4. Considering the submissions made, the Writ Petition is disposed of giving liberty to the Petitioners to work out their remedies before appropriate forum. Police are directed not to visit the house of the Petitioners and are further directed to follow due process of law. There shall be no order as to costs.
