The petitioner has been made accused in connection with R.I.T. Case No. 45 of 2023 corresponding to POCSO Case No. 16 of 2023, for the offences registered under Sections 363, 366, 34 of the I.P.C., subsequently chargesheet has been submitted under Sections 363, 366 & 109/34 of the I.P.C. and Section 4 of the POCSO Act, pending in the Court of learned Additional Sessions Judge-1, Seraikella. 3. The bail application of the petitioner was twice rejected by this Court earlier. 4. The petitioner is alleged to have enticed away the daughter of the informant. Later on, she was drugged and sexually assaulted. 5. Learned counsel appearing on behalf of the petitioner submitted that the statement of the victim was recorded during the trial, in which she has not stated against the petitioner that he had sexually assaulted her. It was further submitted that some of the accused persons have been granted bail by the co- ordinate Bench of this Court. 6. Report regarding the stage of trial, earlier called for has been received. It appears that out of 10 witnesses, prosecution has examined 7 witnesses. 7. In view of the aforesaid facts, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected once again. 8. Learned Trial Court shall expedite the trial expeditiously without giving undue adjournment to the prosecution. (Ambuj Nath, J.) Rahul/-
