Heard the learned counsel appearing for the parties. 3. FIR in Crime No.100/2025 was registered by Gowribidanur Police Station, Chikkaballapura District for the aforesaid offence against the petitioner herein, on the basis of first information dated 21.05.2025 received from the victim lady, aged about 25 years. During the course of investigation, the petitioner herein was arrested and remanded to judicial custody on 21.05.2025. 4. The bail application filed by the petitioner before the jurisdictional Sessions Court in Crl.Misc.No.298/2025 was dismissed on 11.06.2025. Therefore, he is before this Court. 5. Perusal of the material on record would go to show that, the petitioner and the victim lady, who is aged about 25 years are acquainted to each other for the last five years and - 3 - HC-KAR NC: 2025:KHC:25592 CRL.P No. 8492 of 2025 the victim lady has stated that they were loving each other. She has further alleged that on 10.08.2024 the petitioner took her to a room in Gangamma complex at Gowribidanur and had sexual intercourse with her with a promise to marry her. She has stated that thereafter the petitioner had sex with her several times and he also had met her relatives and stated that he would marry her. She has further stated that she came to know that the petitioner has now married another girl. It is under these circumstances, she has approached the police. 6. From the averments found in the FIR it appears that the petitioner and the victim lady were in consensual relationship for a considerable period of time and it is only after the said relationship failed for the reason that the petitioner has married another girl, the victim lady had approached the police. The petitioner, who has no other criminal antecedents is in custody from 21.05.2025. Major portion of the investigation is completed. 7. Considering the aforesaid aspects of the matter, I am of the opinion that, the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. - 4 - HC-KAR NC: 2025:KHC:25592 CRL.P No. 8492 of 2025 8. Accordingly, the following: ORDER Criminal Petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.100/2025 registered by Gowribidanur Police Station, Chikkaballapura District, for the offence punishable under Section 69 of BNS, 2023, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE NMS
