Petitioner has been made an accused in connection with Satgawan P.S. Case No. 67 of 2023, Corresponding to Special POCSO Case No. 32 of 2023 registered for the offence under sections 363, 366(A) of the Indian Penal Code, later on charges were framed for the offence under sections 363, 366, 376(2)(n), 376(3), 506 of the Indian Penal Code and under section 6 read with 5(1) of the POCSO Act pending in the court of learned District & Additional Sessions Judge-III- cum Special Judge, POCSO Court, Koderma.
The petitioner is alleged to have kidnapped the victim with the intention to marry her.
Statement of the victim was recorded under section 183 of the B.N.S.S, in which she has stated that the petitioner had forced her to leave her lawful guardianship. She has also stated that she was taken to Bengal by the petitioner and was raped three to four times.
Learned lawyer for the petitioner submitted that the medical report does not support the allegation.
Regard being had to the facts and circumstance of the case and considering the nature of the allegation; I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is hereby rejected at this stage.
